You\u2019re probably totally overwhelmed by all the GDPR compliance emails, blog articles, reminders, and more. Let\u2019s investigate\u2026<\/p>\n<hr \/>\n<h2 id=\"2969\" class=\"graf graf--h3 graf-after--p\" style=\"text-align: center;\"><strong>Is the GDPR Really That Serious?<\/strong><\/h2>\n<p id=\"f709\" class=\"graf graf--p graf-after--h3\">In short, yes. There are confusing legal matters to navigate, a total re-work of lots of tools and processes, a looming final deadline, and big fines to contend with if you\u2019re not compliant.<\/p>\n<p><img decoding=\"async\" class=\"aligncenter wp-image-14341 size-full\" title=\"will ferrell saying everybody panic\" src=\"https:\/\/zenkit.com\/wp-content\/uploads\/2019\/04\/panic.gif\" alt=\"gdpr panic\" width=\"218\" height=\"145\" \/><\/p>\n<p id=\"7158\" class=\"graf graf--p graf-after--figure\">All that being said, you shouldn\u2019t panic. While this all seems kind of scary (and more than a bit complicated and annoying to deal with), it\u2019s actually a really positive thing in the end!<\/p>\n<hr \/>\n<h2 id=\"c802\" class=\"graf graf--h3 graf-after--p\" style=\"text-align: center;\"><strong>The Plus Side of GDPR<\/strong><\/h2>\n<p id=\"b0a5\" class=\"graf graf--p graf-after--h3\">While we have always taken data privacy very seriously at Zenkit, the GDPR forces us to up our game and take it to the next level. Being GDPR compliant\u2026<\/p>\n<ul class=\"postList\">\n<li id=\"db42\" class=\"graf graf--li graf-after--p\">Improves and future-proofs our processes<\/li>\n<li id=\"9f0d\" class=\"graf graf--li graf-after--li\">Makes us review and re-work our agreements<\/li>\n<li id=\"e6cf\" class=\"graf graf--li graf-after--li\">Helps us to map and simplify how data is handled<\/li>\n<li id=\"3aa6\" class=\"graf graf--li graf-after--li\">Makes our handling of data clearer to you, the user<\/li>\n<li id=\"567b\" class=\"graf graf--li graf-after--li\">Ensures that our team are fully aware of the best practices<\/li>\n<\/ul>\n<p id=\"09ed\" class=\"graf graf--p graf-after--li\">Basically, it ensures that our data handling processes are state-of-the-art and that absolutely everything is documented so we can easily understand where personal data comes from and where it\u2019s going.<\/p>\n<hr \/>\n<h2 id=\"acc7\" class=\"graf graf--h3 graf-after--figure\" style=\"text-align: center;\"><strong>The GDPR in a Nutshell<\/strong><\/h2>\n<p id=\"2d61\" class=\"graf graf--p graf-after--h3\">GDPR stands for the\u00a0<strong class=\"markup--strong markup--p-strong\">General Data Protection Regulation<\/strong>. It is the European Union\u2019s (EU\u2019s) new regulation that safeguards the personal data of individuals in the EU, as well as the export of personal data abroad.<\/p>\n<blockquote id=\"a58d\" class=\"graf graf--pullquote graf-after--p\"><p><em class=\"markup--em markup--pullquote-em\">If you process personal data on EU residents, you need to comply with GDPR, no matter where in the world you\u2019re\u00a0based.<\/em><\/p><\/blockquote>\n<p id=\"7bc4\" class=\"graf graf--p graf-after--pullquote\"><strong class=\"markup--strong markup--p-strong\">Personal data = anything that could be used to identify someone<\/strong> (either on its own or in combination with other information). It\u2019s a very broad definition and means that you need to be very careful about the data you capture and process.<\/p>\n<p id=\"54c3\" class=\"graf graf--p graf-after--p\">There are 3 parties involved in the GDPR relationship:<\/p>\n<ul class=\"postList\">\n<li id=\"0d54\" class=\"graf graf--li graf-after--p\"><strong class=\"markup--strong markup--li-strong\">The data subject<\/strong>: The person whose personal data is being stored\/processed.<\/li>\n<li id=\"7b1f\" class=\"graf graf--li graf-after--li\"><strong class=\"markup--strong markup--li-strong\">The data controller:<\/strong>\u00a0The person or entity who determines the purpose and means for processing personal data.<\/li>\n<li id=\"ad18\" class=\"graf graf--li graf-after--li\"><strong class=\"markup--strong markup--li-strong\">The data processor:<\/strong>\u00a0The person or entity responsible for processing the data on behalf of the controller.<\/li>\n<\/ul>\n<p id=\"c729\" class=\"graf graf--p graf-after--li\">At Zenkit we are a data controller when we provide customer service, send newsletters and updates, keep data on our employees, or keep your email address to provide the Zenkit service. We are a data processor for our customers.<\/p>\n<p id=\"078f\" class=\"graf graf--p graf-after--p\">If you are a customer of Zenkit, we will soon provide all of the necessary legal documents, such as a Data Processing Agreement, to make sure that you are also fully compliant. Essentially, signing such an agreement will ensure that you as a data controller (who controls data about your customers) are employing a data processor (that\u2019s us!) that complies with the new regulations.<\/p>\n<hr \/>\n<h2 id=\"c167\" class=\"graf graf--h3 graf-after--figure\" style=\"text-align: center;\"><strong>The Principles Behind the GDPR<\/strong><\/h2>\n<p id=\"a852\" class=\"graf graf--p graf-after--h3\">There are 6 principles laid out in article 5 of the GDPR that the data controller must be responsible for and be able to comply with. They are clear, logical, and put the interests of the data subject at heart. The principles state that data must be\u2026<\/p>\n<ol class=\"postList\">\n<li id=\"b338\" class=\"graf graf--li graf-after--p\">Processed lawfully, fairly, and transparently.<\/li>\n<li id=\"0bf1\" class=\"graf graf--li graf-after--li\">Collected for specified, explicit, and legitimate purposes.<\/li>\n<li id=\"0d5d\" class=\"graf graf--li graf-after--li\">Adequate, relevant, and limited to what is necessary in relation to the purposes for which they\u2019re processed.<\/li>\n<li id=\"4a36\" class=\"graf graf--li graf-after--li\">Accurate and kept up to date, and that inaccurate data are erased or rectified.<\/li>\n<li id=\"2123\" class=\"graf graf--li graf-after--li\">Kept in a form that allows for the identification of data subjects for no longer than is necessary.<\/li>\n<li id=\"513f\" class=\"graf graf--li graf-after--li\">Processed in a way that ensures appropriate security of the personal data.<\/li>\n<\/ol>\n<p id=\"241c\" class=\"graf graf--p graf-after--li\">Article 5(2) requires that \u201cthe controller shall be responsible for, and be able to demonstrate, compliance with the principles.\u201d<\/p>\n<p id=\"0679\" class=\"graf graf--p graf-after--p graf--trailing\">To that effect, we as a data processor have published a\u00a0<a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/zenkit.com\/gdpr\" target=\"_blank\" rel=\"noopener noreferrer\" data-href=\"https:\/\/zenkit.com\/gdpr\">GDPR FAQ<\/a>\u00a0on our site, that will be regularly updated if\/when any changes are made to our privacy practices.
